These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Nicofitpro Ltd ("we," "us," or "our"), concerning your access to and use of our mobile application and online personal coaching services.

By accessing the App and purchasing our services, you agree that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the App and must discontinue use immediately.

1. Eligibility & Medical Disclaimer

Age Requirement: You must be at least 18 years of age to use our coaching services.
Not Medical Advice: Our coaches provide fitness, lifestyle, and nutrition guidance. We are not medical professionals. The information provided through the App is for educational and informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.
Assumption of Risk: You explicitly agree that your participation in any fitness program involves inherent risks of physical injury. You assume all risks associated with your training and should consult a doctor before starting any new physical regimen.

2. Accounts & Onboarding

Registration: To access our services, you must create an account. You agree to provide accurate, current, and complete information during registration.
Coach Assignment: As part of our onboarding process, our system will match you with a dedicated trainer based on your goals, lifestyle, and schedule. While we strive for the perfect match, you may request to try a different coach at any time by contacting support or via the App settings.

3. Subscription, Payments, & Fees

Billing: All fees for our coaching services are billed in advance on a subscription or package basis. Payments are processed securely via third-party providers (e.g., Stripe, Apple, or Google).
No Free Trials: Because our coaches immediately invest significant, dedicated hours into custom-building your program from scratch on Day 1, we do not offer free trials.

4. 30-Day Action-Based Guarantee & Refund Policy

We back our coaching expertise with a balanced, conditional refund policy designed to protect both your investment and our coaches' labor.

The Guarantee: If you purchase a program, follow it actively for thirty (30) days, and decide it is not the right fit for you, you are eligible to request a 50% refund of your initial fee.
Action-Based Requirement: To qualify for this 50% refund, you must demonstrate that you have actively participated in and followed the program (e.g., logging workouts, tracking meals, and maintaining communication with your coach as prescribed) during the first 30 days.
Trainer Compensation: The remaining 50% of the fee is strictly non-refundable. This retention covers the direct hours, elite expertise, and tailored program development invested by your coach on Day 1.
How to Claim: To request a refund under this guarantee, please email our support team within 30 days of your purchase with your account details.

5. Acceptable Use & 24/7 Messaging

Prohibited Behavior: You agree not to abuse, harass, threaten, or use inappropriate language toward your personal coach or any other staff members. We reserve the right to terminate your account immediately without a refund if you violate this rule.
24/7 Access Availability: While you are welcome to send text messages to your dedicated trainer 24/7, response times may vary based on time zones, sleeping schedules, and coach availability. Your coach will respond as promptly as possible during their operational hours.

6. Intellectual Property Rights

Unless otherwise indicated, the App and all source code, databases, functionality, software, website designs, audio, video, text, and training/nutrition plans generated by our coaches are owned or licensed by us, and are protected by copyright and trademark laws. You are granted a limited license to use these materials solely for your personal, non-commercial fitness journey.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will we or our directors, employees, or coaches be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including injury, loss of profits, or loss of data arising from your use of the App or services.

8. Governing Law & Dispute Resolution

These Terms and your use of the App are governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law principles.

Any legal action or dispute arising out of or in connection with these Terms shall be brought exclusively before the courts of Hong Kong, and you hereby consent to the exclusive jurisdiction of such courts.
